Restricted access

Access to certain areas of this website is restricted. Zapnito reserves the right to restrict access to areas of this website, or indeed this entire website, at Zapnito’s discretion.

If Zapnito provides you with a user ID and password to enable you to access restricted areas of this website or other content or services, you must ensure that the user ID and password are kept confidential.  You must use a password that is non-guessable by another person through a combination of words or characters uniquely known to you.  You must not use guessable words or characters such your name or date of birth.  You must not use the same password for multiple accounts and you must not write the password down.  It is acceptable to use a password manager or password safe such as 1Password.

Zapnito may disable your user ID and password in Zapnito’s sole discretion without notice or explanation. Without limiting the generality of the previous sentence, Zapnito may disable your user ID and password if it considers that you have breached any of these terms and conditions or its Community Policy.

User content

In these terms and conditions, “user content” means material (including without limitation text, images, audio material, video material and audio-visual material) that you submit to this website, for whatever purpose.

Any user content you upload to this website will be considered non-confidential and non-proprietary. You grant to Zapnito a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content and make it available to third parties in any existing or future media. You also grant to Zapnito the right to sublicense these rights, and the right to bring an action for infringement of these rights.

Your user content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against you or Zapnito or a third party (in each case under any applicable law). 

You must not submit any user content to this website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.

Zapnito reserves the right to edit or remove any material submitted to this website, or stored on Zapnito's servers, or hosted or published upon this website. We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our website constitutes a violation of their intellectual property rights or their right to privacy. 

Notwithstanding Zapnito’s rights under these terms and conditions in relation to user content, Zapnito does not undertake to monitor the submission of such content to, or the publication of such content on, this website. The user content on this website is, therefore, not verified or approved by us. The views expressed by other users on our website do not represent Zapnito’s views or values. 

No warranties

This website is provided “as is” without any representations or warranties, express or implied. Zapnito makes no representations or warranties in relation to this website or the information and materials provided on this website. 

Without prejudice to the generality of the foregoing paragraph, Zapnito does not warrant that:

  • this website will be constantly available, or available at all; or

  • the information on this website is complete, true, accurate or non-misleading.

  • any other matter for which it would be illegal or unlawful for Zapnito to exclude or limit, or to attempt or purport to exclude or limit, its liability. 

Other parties

Unless it expressly states otherwise, these terms and conditions do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these terms and conditions. 

Indemnity

You hereby indemnify Zapnito and undertake to keep Zapnito indemnified and hold Zapnito harmless against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by Zapnito to a third party in settlement of a claim or dispute on the advice of Zapnito's legal advisers) incurred or suffered by Zapnito arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.

Breaches of these terms and conditions

Without prejudice to Zapnito’s other rights under these terms and conditions, if you breach these terms and conditions in any way, Zapnito may take such action as Zapnito deems appropriate to deal with the breach, including suspending your access to this website, prohibiting you from accessing this website, blocking computers using your IP address from accessing this website, contacting your internet service provider to request that they block your access to this website and/or bringing court proceedings against you.

Variation

Zapnito may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Please check this page regularly to ensure you are familiar with the current version.

Assignment

Zapnito may transfer, sub-contract or otherwise deal with Zapnito’s rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.

You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

Where our website contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those websites or resources.

Severability

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Entire agreement

These terms and conditions, together with our Community Policy, constitute the entire agreement between you and Zapnito in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.

Law and jurisdiction

These terms and conditions will be governed by and construed in accordance with the laws of England and Wales, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of England and Wales.

Job Application Privacy Notice 

As part of any recruitment process, Zapnito collects and processes personal data relating to job applicants.  The organisation is committed to being transparent about how it collects and uses that data and to meeting its data protection obligations.  The personal data will be collected by Zapnito Ltd, 08406532.  Registered office: 86-90 Paul Street, London, EC2A 4NE, United Kingdom. What information does the organisation collect?

The organisation collects a range of information about you:

  • your name, address and contact details, including email address and telephone number;

  • details of your qualifications, skills, experience and employment history;

  • information about your current level of remuneration, including benefit entitlements;

  • whether or not you have a disability for which the organisation needs to make reasonable adjustments during the recruitment process;

  • information about your entitlement to work in the UK; and

  • equal opportunities monitoring information, including information about your ethnic origin, sexual orientation, health, and religion or belief.

The organisation collects this information in a variety of ways.  For example, data might be contained in application forms, CVs or resumes, obtained from your passport or other identity documents, or collected through interviews or other forms of assessment.

The organisation will also collect personal data about you from third parties, such as references supplied by former employers.  The organisation will seek information from third parties only once a job offer to you has been made and will inform you that it is doing so.

Data will be stored in a range of different places, including on your application record, in HR management systems and on other IT systems (including email).

Why does the organisation process personal data?

The organisation needs to process data to take steps at your request prior to entering into a contract with you.  It also needs to process your data to enter into a contract with you.

In some cases, the organisation needs to process data to ensure that it is complying with its legal obligations.  For example, it is required to check a successful applicant's eligibility to work in the UK before employment starts.

The organisation has a legitimate interest in processing personal data during the recruitment process and for keeping records of the process.  Processing data from job applicants allows the organisation to manage the recruitment process, assess and confirm a candidate's suitability for employment and decide to whom to offer a job.  The organisation may also need to process data from job applicants to respond to and defend against legal claims.

The organisation processes health information if it needs to make reasonable adjustments to the recruitment process for candidates who have a disability. This is to carry out its obligations and exercise specific rights in relation to employment.

Where the organisation processes other special categories of data, such as information about ethnic origin, sexual orientation, health, religion or belief, age, gender or marital status, this is done for the purposes of equal opportunities monitoring with the explicit consent of job applicants, which can be withdrawn at any time by contacting people@zapnito.com 

If your application is unsuccessful, the organisation will keep your personal data on file for 12 months in case there are future employment opportunities for which you may be suited.  Free to withdraw your consent at any time by contacting people@zapnito.com

Who has access to data?

Your information will be shared internally for the purposes of the recruitment exercise.  This includes members of the People team, interviewers involved in the recruitment process, managers in the business area with a vacancy and IT staff if access to the data is necessary for the performance of their roles. 

The organisation will not share your data with third parties, unless your application for employment is successful and it makes you an offer of employment.  The organisation will then share your data with former employers to obtain references for you, employment background check providers to obtain necessary background checks and the Disclosure and Barring Service to obtain necessary criminal records checks.  

How does the organisation protect data?

The organisation takes the security of your data seriously.  It has internal policies and controls in place to ensure that your data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by our employees in the proper performance of their duties. 

For how long does the organisation keep data?

If your application for employment is unsuccessful, the organisation will hold your data on file for 12 months after the end of the relevant recruitment process.  At the end of that period, your data is deleted or destroyed.

If your application for employment is successful, personal data gathered during the recruitment process will be transferred to your personnel file and retained during your employment. The periods for which your data will be held will be provided to you in a new privacy notice.

Your rights

As a data subject, you have a number of rights. You can:

  • access and obtain a copy of your data on request;

  • require the organisation to change incorrect or incomplete data;

  • require the organisation to delete or stop processing your data, for example where the data is no longer necessary for the purposes of processing;

  • object to the processing of your data where the organisation is relying on its legitimate interests as the legal ground for processing; and

  • ask the organisation to stop processing data for a period if data is inaccurate or there is a dispute about whether or not your interests override the organisation's legitimate grounds for processing data.

What if you do not provide personal data?

You are under no statutory or contractual obligation to provide data to the organisation during the recruitment process.  However, if you do not provide the information, the organisation may not be able to process your application properly or at all.  If your application is successful, it will be a condition of any job offer that you provide evidence of your right to work in the UK and satisfactory references.

You are under no obligation to provide information for equal opportunities monitoring purposes and there are no consequences for your application if you choose not to provide such information.
